The website www.geminifundation.com (hereinafter also “Site”) is a service aimed at promoting the Foundation's services and activities. The Foundation also allows Users who freely access the Site to enter, publish and disseminate personal comments and content online (hereinafter, the "Contents"), completely autonomously and under their full and exclusive responsibility, in a space virtual environment technically prepared to welcome them within the Site. Users hereby acknowledge and accept that the Contents they enter into the Site will be available, free of charge and for their entire stay online, to other Users of the Site Use of the Site is subject to acceptance of the terms and conditions set out below. If you do not intend to accept, you are invited not to use the Site and not to download any material from it.

The information contained on this Site is provided in good faith and the Foundation believes it to be accurate. Foundation does not provide any guarantee that the Site and the information contained therein are free of errors or viruses, are complete and truthful and/or do not violate the rights of third parties nor that they comply with the laws and traditions of foreign countries. The information contained on this Site may be technically inaccurate or affected by typographical errors. Information can be modified or updated without any warning. Foundation may also improve, change or eliminate certain sections of this site without notice. Under no circumstances will the Foundation be held responsible for any direct or indirect damage caused by the use of this Site.

Gemini assumes no responsibility for materials created or published by third parties with which the site has a link. Anyone who decides to visit a site does so at their own risk, assuming the responsibility of taking all necessary measures against viruses or other destructive elements. The link to other sites does not imply that the Foundation sponsors or is affiliated with the entities that provide the services described on those sites.

Information received by the Foundation
Any communication or material sent to the Foundation, for example via e-mail or through the World Wide Web pages, will be deemed to be of a non-confidential nature, with the exception of the personal data provided to register on the website www.geminifundation.com, however, present in the material sent in order to participate in the tenders, which will instead be processed pursuant to Legislative Decree 196/2003 and subsequent additions and amendments, as indicated in the Privacy Policy available on the Site itself. The Gemini Foundation will have no obligations of any kind with respect to such material and will be free to reproduce, use, reveal, display, transform it, make derivative works of it and distribute it to third parties, without limits. Furthermore, Foundation will be free to use any ideas, concepts, know-how or technical knowledge contained in such material. Anyone who sends material guarantees that it is publishable and agrees to hold the Foundation harmless from any action by third parties in relation to such material.

Use of interactive services – Guarantees and responsibilities

Users expressly recognize that the use of the interactive services made available by the Foundation through the Site (hereinafter also "Services") is strictly personal. Users are prohibited from making any commercial use of the Services. Users may not use the Services to promote the sale of products or services or to increase the number of visitors to their site(s). Foundation may, without being obliged to, monitor the Contents that will be uploaded by Users to the Site, as well as monitor and/or control any part of the Site in which Users transmit/place the Contents. Furthermore, the Foundation may at any time and without notice reject, refuse to include on the Site, not use, remove, block with an access ban and/or delete Content deemed inadequate or which in any way contravenes the provisions of this Regulation, without being held liable in any way towards the Users. Without prejudice to the foregoing, Users undertake to use the Services exclusively for lawful purposes and permitted by the provisions of law applicable from time to time, by customs and practices, by the rules of diligence and in any case without infringing any rights of third parties. Users, in particular, acknowledge that it is forbidden to insert, publish, disseminate in the web space made available to them, Contents: i) of an offensive, injurious, defamatory, libelous, pornographic, vulgar, obscene, paedo-pornographic, blasphemous and in any way that does not comply with the principles of public order and morality or that may cause harm in any way to minors; ii) that cause a nuisance to public or private peace or offend or damage, directly or indirectly, anyone or that encourage third parties to carry out illicit and/or criminal conduct liable to criminal or civil liability; iii) that violate current legal regulations, including, by way of example, the provisions of the LoA, as well as the Privacy Code, or distinctive signs, intellectual or industrial property rights or other rights of third parties; iv) that contain viruses or other programs aimed at damaging or interfering with the correct functioning of the Services, causing an unreasonable overload of activity of the technological infrastructures and Telecom Italia servers that host the Foundation Site or at intercepting or appropriating operating systems, personal data or information or violate, steal or suppress computer or telematic correspondence with third parties; v) containing unsolicited and unwanted advertising, promotional material or any other form of solicitation. Users guarantee the origin and originality of the Content entered via the Services. Users undertake not to copy, reproduce, process, alter, modify, transcribe, duplicate, communicate, distribute or otherwise disclose any material protected by copyright without express authorization in writing or without the express consent of the third party rights holders of intellectual property. Users are aware that violation of these provisions is punishable pursuant to articles. 171 ff. of the LoA. Any material protected by intellectual property rights may be inserted in the aforementioned space only if the Users have acquired the related rights of use from the right holder and, therefore, only with the written permission of the right holder and with the obligation to cite the source and existence of the permit.

Disabling and Deleting Content

It is understood that in the event of violation by the Users of the provisions and guarantees referred to in the previous paragraph or in any case, if the Foundation becomes aware, in any way, that the Users have used the Services in non-compliance with the provisions of this Regulation and/ o receive a documented notification and/or warning regarding the risk of the aforementioned violation; or ii) if any dispute arises or any claim, demand and/or demand of any kind is made by third parties against the Foundation in relation to the Contents; or iii) if the Foundation believes, at its sole discretion, that the Contents may cause damage to third parties or to itself; or iv) if the Services are used by Users for commercial purposes; or v) in the event of a request from competent authorities, the Foundation will have the right, at its complete discretion, without prejudice to any other remedy provided by law, to take any measure or initiative it deems appropriate and/or necessary, including the removal or cancellation of the Contents , as well as the suspension or cancellation of the User's account, immediately disabling their access to the Services without any prior notice. Users acknowledge that in the event that the Foundation, in the usual checks on the functionality of the Services, should accidentally become aware of alleged illegal activities carried out by Users, it is required and will immediately, pursuant to applicable laws, forward a specific report to the competent Authorities , providing, upon request of the latter, the information in their possession.

Cookies

A "cookie" (i.e. a small data file that some websites, when visited, can send to the visitor's address) may be located somewhere on the Site, in order to track the visitor's paths on the Site. If you prefer not receive cookies, you can set your browser to warn you of the presence of a cookie and then decide whether to accept it or not. Law and jurisdiction

This Regulation is governed by Romanian law. The Court of Bucharest Romania will have exclusive jurisdiction and competence for any disputes connected to this Regulation. Nonetheless, the Gemini Foundation reserves the right, if it deems it necessary, to take legal action before courts in countries or cities other than Romania or Bucharest to protect its interests and enforce its rights.
